Motion for Sanctions - Florida Statute 57.105

 

The Florida Supreme Court, in In Re: Amendments to the Florida Rules of Appellate Procedure, 35 Fla. L. Weekly S367a (Fla. 2010), has amended the appellate rules so they are now consistent with the filing of a motion for sanctions under Florida Statue 57.105.  Florida Statute 57.105 imposes sanctions upon a party when it  raises a claim or defense that is not supported by the material facts or then existing law to those material facts.  Appellate Rules 9.410, 9.300(a) and 9.400(b) were amended to provide the same relief for bad faith filings in an appellate case as that for any other civil case.  Please see the Appendix of the full opinion for the complete rule changes and text.
